TERMS & CONDITIONS OF THE FAME FILM SHORTS FESTIVAL

1.     PREAMBLE

1.1 The FAME Film Shorts Festival (“the Festival”) is a Forum dedicated to short films hosted by FAME. Neither a selection, nor a competition, but a designated market area will be allocated at the event known as FAME week Africa (“the Event”), designed to boost networking between professionals. 

1.2 Registering at the Festival is reserved to short films with cinema artistic values. After viewing your film, we reserve the right to refuse a registration without having to justify our decision.

2.     FUNDAMENTAL REGISTRATION CONDITIONS

2.1 Registration is exclusively open to short films:

 i.   Having been produced after 1st January 2020 to March 2023;

 ii.  Not exceeding 30 minutes, there is no minimum running time;

iii.  Only entries eligible by African Filmmakers currently residing in Africa will be considered.

iv.  Presenting the cinema characteristics of a short film, especially in terms of narration, photography, soundtrack, editing, etc.

v.   Submitted by one of the film's right holders, agreeing to guarantee his/her presence in Cape Town during the event.

vi.  Film selection for the Festival will be made by the Festival Committee.

2.2  Participants are expressly forbidden to make use of products or rights, in any form, in violation of legislative or regulatory clauses as well as of international conventions concerning copyright and counterfeit. FAME reserves the right to refuse the registration of any film which is liable to disturb public order, or which may be offensive to religion, as well as pornographic films and films which encourage violence, including all associated poster and documentation. Any infringement of this rule, duly verified, will result in the immediate application for removal of the film from the Event. Furthermore, the offender will not be allowed to participate at the FAME Film Festival for a period of two years.

2.3  Participants confirm that they are over the age of 18 years.

2.4  Companies, institutions, associations, or organizations undertaking registration at the festival on behalf of third parties agree to make known and have accepted these Terms and conditions by those registered and they vouch for the perfect respect of these Terms and conditions by all third parties. Moreover, they agree to act with perfect respect of the Terms and conditions specified and to communicate immediately to FAME all useful information concerning those registered. In case of non-respect of this clause, registrations will be cancelled.

2.5  FAME is under no obligation to provide to the Participant or any other representative of the film any comments or feedback regarding the submission.

2.6  FAME reserves the right to choose a successful participant for the Festival at its sole discretion.

2.7  The participant will be contacted before the official press conference should their film be selected.

2.8  All non-English films must have English sub-titles.

2.9 FAME does not allow multiple category entries.

2.10   Participants are to NOT send stills or press kits. If the film is selected, FAME will ask the participant to email FAME a still image.

2.11 FAME is permitted to retain copies of each film selected as part of the festival library and for media educational use or for FAME event true throughout the year.

2.12 The Participant may submit more than one film, but each film must be accompanied by its own completed submission form.

2.13  FAME retains the right to change the date and venue of the festival under special circumstances. All Participants will be informed about any changes through email and on the FAME online platforms.

2.14  FAME places no restrictions on the participants work in terms of premiere status or whether your work has been made available online.

2.15  The Participant must supply FAME either with a DCP (Digital Cinema Package), a JPEG 2000 file or a 35mm print, shot on 35 mm, 16mm, 8mm or HD.

2.16  FAME will send the successful Participant all the necessary information in due time, but only if the film is selected.

3.     REGISTRATION

3.1 Once the online registration has been validated on the FAME website, the Participant is obliged to heed to the present terms and conditions. The Participant must guarantee the exactitude of all the entered information. FAME will watch the film upon its upload and can reserve the right to refuse registration of films which do not fit the admission criteria laid down in the terms and conditions, without any obligation to justify its decision. The total amount of films which FAME is likely to add to the Festival is limited. For your information, the process to accept films will start in March until early May. In order to guarantee a privileged access to all films, FAME is likely to unilaterally close registrations, as soon as the quota set will be reached. At the latest, the registration deadline will be on 30th June 2023.

3.2  During the registration process, the film has to be uploaded directly through FilmFreeway. 

3.3 Only films in original version with English subtitles or films in English will be viewed.

3.4 Films have to be uploaded by 30 June 2023, at the latest. After this date, FAME will not be able to guarantee the uploading of the film to the festival server and its availability at the event. If so, corresponding registrations will be cancelled.

3.5  All films registered at the festival will be digitalized. The digitalization quality of the films being dependent on the technical quality of the supports originally uploaded, FAME cannot be held responsible for the quality of broadcasting at the Event and the interactive screens. The participant must make sure their film is downloaded successfully by responding to the questions at the end of the downloading process.  In the case of difficulty to upload, we could authorize another upload, or a DVD can be requested. All transportation costs, as well as the shipping agent's and insurance fees, are entirely borne by the sender. We inform you that the Video DVD sent will not be returned.

4.     PUBLICATION AND BROADCASTING AUTHORIZATIONS

4.1 All film registrations give FAME the authorization to publish in its communication media, including the printed catalogue and the databases online, elements from the registered shorts films (clips, stills, quotes…), for promotional ends, as well as all the entered information about the Participants, including his/her photo, unless contrary stipulated by letter received to the latest one month prior to the Festival. The Participant guarantees to FAME that he/she has all rights concerning the copyright of these elements and guarantees FAME against any third-party action. The participant confirms that all copyright rights and all the rights to use the music are regulated and assumes full financial responsibility of the third parties. (FAME does not pay royalties when the films are shown publicly). Moreover, the Participant confirms and accepts that participation in all Festival and FAME events may entail photographic, filmed, or digital reproduction, including via internet and mobile phones, whether for promotional or commercial ends.

4.2 The participant confirms that the film entered into the competition may be shown to the audiences of FAME free of charge as well as any other events related to the festival, as well as on the FAME website, without any additional charges and or permits.

4.3 The participant understands that they will not be entitled to financial gain or other remuneration for the film being showcased at the Event, either for the initial, subsequent or playback transmission.

4.4  The participants transfer the right to the festival organiser/s to use part of the video (30 sec) in order to promote the festival in all its forms, including television, Internet, and Social Media.

5.     UNAUTHORIZED USE OF FAME LOGOTYPES

5.1 The Participant agrees to proscribe any unauthorized use of the FAME Competition logo, strictly reserved to the films selected in Competition. The Participant also agrees to proscribe the use of any other logo from the Event.

5.2 Any infringement of this rule, duly verified, will result in the immediate application of the cancellation of the film’s registration.

5.3 Any infringement of the same, as well as non-respect of the security rules, public order, and the police, can entail, at the organizer’s will, without an official warning, the immediate cancellation, temporary or permanent. Furthermore, the Participant will not be allowed to participate in the Short Film Corner for two years.

6.     LIABILITY OF FESTIVAL

6.1 FAME reserves the right to reclassify the films by referring them to other categories when deemed appropriate. FAME declines any responsibility for entries of films that are classified in the wrong category or enter the Festival registrations after the deadline stipulated for this purpose.

6.2  FAME’s liability is limited to circumstances of wilful or negligent conduct that apply only in the event of loss or damage of a submitted work. FAME accepts no responsibility for the cancellation of the Festival due to force majeure and beyond its control.

7.     PRIVACY

7.1 The participants agree that their name and identity may be disclosed therein or by descriptive text or commentary. The participant hereby releases FAME, its agents, and employees all rights to exhibit this work in print and electronic form publicly or privately.

8.     FORMAT REQUIREMENTS

8.1 Accepted file formats (endings): .mp[e]g / .avi / .vob / .mov / .mp4 / .m4v.

8.2 Recommended codecs: MJPEG, Apple ProRes, H264 (high bitrate if possible: minimum 2MBit/s and Uncompressed (very large files!).

8.3 Resolution: PAL or NTSC (as well as SECAM) from 720x400px up to HD material of 1920x1080px.

8.4  File specifications: FAME will only accept multiplexed files (i.e. with audio, video and subtitles in a single file). Participants film files should not exceed 8 GB. The higher the resolution, the better the quality of scanning. You can upload a film with a resolution of up to 1920x1080 pixels (HD), as long as it does not exceed 8 GB.

8.5  Subtitles: the Selection Committee will screen films: WITHOUT subtitles if the original language is English. WITH English subtitles for all other original languages. For subtitled films, the subtitles must be integrated into the image.

9.     NOMINATED FILMS

9.1   These are all the films that have been nominated for an award in a category. Not all nominated films will be screened at the Event.

10.   OFFICIAL SELECTION

10.1   These are all the nominated films selected for screening, which will be notified via email. Where a participant receives a Nomination email, but no Official Selection email, it means that the participants film will not be screened but is still a contender for an award in its category.

11.   AWARD WINNERS

11.1 Chosen from the Nominations (which includes the Official Selection).

12.   EXCLUSION

12.1 Any infringement of these terms and conditions, as well as non-respect of security rules, public order, and the police, can entail, at FAME’s will, the immediate cancellation, temporary or permanent, of the Participant's badges, the immediate cancellation, temporary or permanent, of the Participant's badges, without any official warning. Where this is the case, the Participant is immediately required to return his/ her badge allowing access to the Event.

13.   APPLICABLE LAW

13.1 This Agreement shall be governed, interpreted, and implemented in all respects in accordance with the laws of the Republic of South Africa.

13.2  Any lawsuit concerning FAME and the Participant, involving the Festival, will be under the jurisdiction of the South Africa

14.     JURSDICTION

The Parties consent to the jurisdiction of the Magistrate’s Court in any action or proceeding otherwise beyond its jurisdiction, it being understood however, the Organizer shall at all times be entitled to bring any such action or proceeding in the High Court. If any action be necessary, each Party to pay own costs and disbursements as between attorney and client unless otherwise stipulated by Order of Court.

15.   MISCELLANEOUS

15.1 By submitting a film to the Festival, the participant accepts the regulations of the contest and all its rules, and the participant shall be entirely responsible for any damages, whether due to his or her own rights or by third parties, caused by the use of his or her.

15.2  Through the film’s submission the participant agrees to our terms and conditions and to receiving marketing newsletters and discounts about film festivals in the form of emails. FAME will never sell your information to third parties.

15.3  FAME reserves the right to update these terms and conditions.
